On May 12, 2025, the UK government announced important changes to its immigration system that will affect people with a British National (Overseas) or BNO status-many of whom are from Hong Kong. Longer Time Needed for Permanent Residency
Starting from April 2026, if you apply for permanent residency (also called “settlement” or “indefinite leave to remain”) through work visas-like skilled worker or healthcare worker visas-you will need to live and work in the UK for 10 years instead of 5. This means it will take twice as long to qualify for permanent residency.
However, if you already have a BNO visa and are following the current “5+1” route (5 years living in the UK plus 1 year before applying for permanent residency), this will not change for now. You can still apply under the existing rules.
Special Status for Current BNO Visa Holders
Luxe Living wants to highlight that the UK government has said current BNO visa holders can continue to apply for permanent residency using the “5+1” route. But for people who apply for a BNO visa after April 2026, the rules might change, and they may need to stay for 10 years before applying for permanent residency. The exact details are still being finalized.
Higher English Language Requirements
The new rules will also raise the English language requirement for permanent residency from level B1 (intermediate) to B2 (upper-intermediate) starting in 2026. This means applicants will need better English skills to qualify. Currently, about 39% of Hong Kong applicants do not meet this higher level, so this will be a bigger challenge for many.
What This Means for BNO Holders
For those already living in the UK on a BNO visa, these changes won’t affect your path to permanent residency right away. Just keep following the current rules, and you should be fine.
But if you plan to come to the UK after 2026, you’ll need to prepare for the new, stricter rules-especially improving your English and getting ready for a longer wait before permanent residency.
Long-Term Impact on UK Immigration
The UK government expects these changes to reduce the approval rate for permanent residency from 92% to 78%, mainly because of the tougher language and contribution requirements. This means the UK will be more selective, focusing on applicants with higher skills and qualifications.
